If the buyer backs out from the deal, the seller has the right for forfeit the token money paid. With respect to such forfeited token money, the buyer cannot claim any income tax benefit, as this is treated as a capital loss under the tax laws.
If the buyer is not able to pay the due amount on the due date, they will be provided with a notice period of 90 days.
In the case, if the buyer is still not in a condition to pay the rest amount, he will get refunded with the previous amount given with a deduction of token money as per previous norms and the property will no longer belong to them.
If the plot has be assigned on loan from our considered bank, i.e., on EMIs , :
* In this case, if the buyer is somehow not able to pay the upcoming EMIs on time, then he will be sub charged.
* Similarly after bouncing of 3 EMIs, he will be offered within 30 days notice period.
*If the buyer is still not able to pay the previous amounts, then with a deduction of token money he will be refunded by bank in 90 days and the property will no longer belong to them.
# In the case of worst, if the company is proved guilty for default in processions, the buyer will be refunded with a deduction of token amount in between 90 days with the sum of bank interest.
